Court Information

The Court Clerks are not permitted to give legal advice, so please do not ask.

The Alden Town Court has two justices who handle all legal matters that come before town residents. The court plays an essential role in the New York State Unified Court System, with jurisdiction over both civil and criminal cases.

The court provides two drop boxes for paperwork:

  • One inside the building
  • One outside the building

If a clerk is not available, please leave documents in either drop box. Staff will process them as soon as possible.

Civil Matters

Alden Town Court hears:

  • Civil actions seeking monetary awards up to $3,000
  • Small claims proceedings for awards up to $3,000
  • Landlord/tenant disputes, including evictions and money judgments for back rent

Small claims court provides a low-cost, informal process for individuals to resolve disputes without needing an attorney (though one may be used).

Criminal Matters

The court handles:

  • Misdemeanors and violations committed within the Town of Alden
  • Vehicle and Traffic Law misdemeanors and traffic infractions
  • Arraignments and preliminary hearings for felony cases

Town Justices are on call 24 hours a day to conduct arraignments. In cases involving domestic violence, they may also issue orders of protection.

Court Sessions

  • 1st & 3rd Tuesday of each month: Criminal matters
  • 2nd Tuesday of each month: Traffic violations

Evening court sessions begin at 4:30 PM.
