The Village of Alden Justice Court plays an important role in protecting the safety and legal rights of Village residents. Like most towns and villages in New York State, the court handles both criminal and civil matters within its jurisdiction.

All criminal acts that occur within the Village of Alden initially fall under the jurisdiction of this court. After an arrest, defendants are arraigned here, where pleas are entered, and bail may be set if applicable.

Adjournments will be granted for good cause.

Criminal Matters

When a defendant appears on a Monday evening, they must appear with their attorney. By that time, the Erie County District Attorney’s Office will have reviewed the case, conducted background checks, and assigned an assistant district attorney (ADA) to negotiate pleas or set trials.

Victims and arresting officers are also typically present during proceedings.

Civil & Small Claims Cases

Residents and businesses located within the Village of Alden may bring civil or small claims actions against:

  • Any individual or business located within Erie County, or
  • Any individual or business that resides or does business within the Village of Alden.

Small Claims Limit: Up to $3,000
Eligibility: Plaintiffs must be individuals (not corporations).

These hearings provide a venue for resolving monetary disputes quickly and affordably without formal legal representation.

Public Access

All criminal, civil, and small claims proceedings at the Village Court are open to the public. Residents are encouraged to attend if they wish to better understand the local judicial process.

Court Sessions

The Village of Alden Court meets every Monday evening to hear criminal, civil, landlord-tenant, traffic, and small claims cases.

  • Arraignments and trials are scheduled as needed.
  • Small Claims and Civil Matters: Heard Monday evenings, up to a monetary limit of $3,000.
  • Traffic and Code Violations: Heard as scheduled.
  • Landlord-Tenant Disputes: Includes eviction proceedings, unpaid rent, or property abandonment.
