The Court Clerks are not permitted to give legal advice, so please do not ask.

Important Notice

This is a part-time court. Phone calls may take 48–72 hours to be returned.

Fine Payments

Court clerks cannot accept fine payments over the phone.

Payments may be made by:

  • Cash
  • Certified check
  • Money order
  • Credit card (MasterCard or Visa only)

A 2.99% service fee applies to all credit card payments.
Personal checks are not accepted.

If you require a receipt, please include a self-addressed stamped envelope.

The Town Court drop box is located outside the Town Hall entrance.

All payments or correspondence must be placed in an envelope.

The Town Clerk’s Office cannot accept payments.

Vehicle & Traffic Court Procedure

It is beneficial (but not required) to mail your plea to the court before your scheduled court date.

  • To Plead Guilty:
    Complete Section A of your ticket and mail it to the court.
    You will receive a fine letter within approximately 2–4 weeks after your plea is received.
  • To Plead Not Guilty:
    Complete the Not Guilty section and mail it to the court.
    You will be notified by mail of a new court date to appear and speak with the Town Prosecutor.

If you do not mail your plea, you are expected to appear on your scheduled court date and enter your plea in person.

It is the defendant’s responsibility to ensure the court has the correct mailing address.

“Fix-It” Ticket Dismissals

Please review your Statement of Correction for Equipment Defect carefully.

  • Inspections are not dismissible in the State of New York.
  • Certain Vehicle & Traffic Law (VTL) violations — including VTL 375, 376, and 381 (except when both headlamps are defective, or violations involving service brakes or audio systems) — may be dismissed if:
    • Proof is presented to the court showing the defect was corrected before ½ hour after sunset on the first business day following issuance of the summons.
      (Per VTL Section 376-a.)

Criminal Calendar

Criminal matters are scheduled on the 2nd and 4th Thursdays of each month.

Please contact the court office or your attorney with any questions regarding your appearance date.

Evictions

Evictions filed in the Town of Collins Court will be heard in Erie County’s Landlord-Tenant HUB Court.
All filings must occur in the local court, not directly with the HUB Court.

For scheduling assistance, contact the Court Clerk’s Office at (716) 532-3340 ext. 114 to obtain a tentative court date for service purposes.

Small Claims & Civil Filings

Small Claims proceedings may be filed by any individual against a person or business that resides in or operates within the Town of Collins.

  • Maximum claim amount: $3,000

Filing fee:

    • $10 for claims up to $1,000
    • $15 for claims $1,001–$3,000

The filing fee must be paid when the application is submitted.
The Court Clerk cannot accept an application without the required filing fee.

Court Sessions

Court is held on the first four (4) Thursdays of each month, beginning at 6:00 PM.

  • 1st Thursday: Vehicle & Traffic / Town Prosecutor
  • 2nd & 4th Thursdays: Criminal / Trials – ADA Night
  • 3rd Thursday: Vehicle & Traffic / Small Claims / Civil
