The Court Clerks are not permitted to give legal advice, so please do not ask.
Fine Payments
Court clerks cannot accept fine payments over the phone.
Payments are accepted Monday through Friday, 9:00 AM – 4:00 PM only.
Payment options:
- Online or by phone at 888-912-1541 (a convenience fee applies)
When paying online, select *“I want to pay a Traffic Ticket – Non-Parking tickets.”
- By mail: Send a money order payable to:

Personal checks are not accepted.
If you require a receipt, please include a self-addressed stamped envelope.
Traffic Tickets
Traffic Court is currently held on a limited basis.
You only need to appear if you have received a letter from the Court notifying you of an appearance date.
- To Plead Guilty:
Complete Section A on your ticket and mail it to the Court.
After your plea is received, you will receive a fine letter within approximately 4–6 weeks. - To Plead Not Guilty:
Complete Section B and mail the ticket to the Court.
The Town Prosecutor will mail you a possible reduced plea offer within 4–6 weeks.
You will not need to appear in court unless you reject the offer.
If your address does not match your driver’s license, contact the Court to update it.
To meet with the Town Prosecutor in person, reject the mailed offer and request a court date.
Failure to Answer Traffic Tickets / Suspension
If you fail to respond to your traffic ticket(s), your driver’s license will be suspended by the New York State Department of Motor Vehicles.
To lift a suspension:
- A $70.00 fee per ticket must be paid.
- You must appear in person or mail in your plea.
The Clerk cannot lift a suspension over the phone.
Paying the suspension fee does not resolve your case.
You must resolve the underlying ticket(s), or your license will be suspended again, resulting in additional fines.
Criminal Matters
All criminal matters are being scheduled for appearances.
If you have recently moved, contact the Court with your updated address to ensure you receive notice of your court date.
Small Claims / Civil / Evictions
Small Claims, Evictions, and Civil filings are accepted at the Court Clerk’s Office on:
Tuesday, Thursday, and Friday – 9:00 AM to 1:00 PM only.
Small Claims
Small Claim proceedings may be filed by individuals against someone who resides or owns a business in the Town of Hamburg.
- Maximum claim amount: $3,000
Filing fee:
- $10 for claims up to $1,000
- $15 for claims $1,001–$3,000
Filing fees are payable upon submission of your application.
Applications cannot be accepted without the filing fee.
Evictions
Eviction filings are accepted Tuesday, Thursday, and Friday, 9:00 AM – 1:00 PM only.
Please note:
- The Court does not provide eviction forms and cannot assist in completing them.
- Evictions filed in the Hamburg Town Court will be heard in Erie County’s Landlord-Tenant HUB Court (Buffalo City Court).
- Filing must first occur in Hamburg Town Court, not the HUB Court.
Service Requirements:
After completing your eviction forms, you must serve the tenant at least 10 days and no more than 17 days before the court date.
Schedule the court date for a Tuesday, Thursday, or Friday at 10:00 AM (control date).
Your notice must state that the tenant is to appear at:

After service is complete, file your completed paperwork at Hamburg Town Court with a $20.00 filing fee.
