Court Information

The Court Clerks are not permitted to give legal advice, so please do not ask.

Fine Payments

Fine payments are accepted Monday through Friday, 9:00 AM – 3:30 PM.

Accepted payment methods:

  • Cash
  • Certified check
  • Money order
  • Visa, MasterCard, or Discover

A 2.99% service fee applies to all credit or debit card transactions.
Credit/debit card payments cannot be accepted by phone.

A payment authorization form is available for mailing in card payments.

Personal checks are not accepted.

Drop Box:
Payments may be placed in the drop box located by the front entrance of Village Hall.

Payments must be in a sealed envelope addressed to the Court and should include your fine notice or clearly list your full name and date of birth.

Evictions

Eviction filings are accepted:
Monday, Tuesday, Thursday, and Friday –
9:30 AM to 3:00 PM

Evictions filed in the Village of Hamburg Court will be heard in Erie County’s Landlord-Tenant HUB Court.

All filings must be made first with the Village of Hamburg Court, not directly with the HUB Court.

For scheduling assistance, contact the Court Clerk’s Office at (716) 649-7204 to obtain a tentative court date for service purposes.

Forms for landlord/tenant proceedings are available from the Court Office.

Civil & Small Claims

Civil and Small Claims filings are accepted:
Monday, Tuesday, Thursday, and Friday – 9:30 AM to 3:00 PM

  • Trial dates are scheduled 22 to 45 days after filing.
  • Small Claims proceedings may be filed against any individual or business located or operating within the Village of Hamburg.
  • Maximum claim amount: $3,000

Criminal Calendar

Criminal matters are scheduled on the first and fourth Wednesday of each month.

Please contact the Court Office or your attorney with any questions about your appearance date.

If you have recently moved, contact the court with your updated address to ensure proper notice of your court date.

Resolving Traffic Tickets (Vehicle & Traffic Infractions)

In-person appearances for traffic matters occur only if the issue cannot be resolved by mail through plea negotiations with the Village Prosecutor.

If you receive a ticket for a New York State Vehicle and Traffic Law (VTL) infraction, you must submit your plea to the court by the appearance date listed on your ticket.

  • Plea of Guilty:
    The Judge will assess a fine and/or surcharge for the offense listed on your ticket.
  • Plea of Not Guilty:
    The Village Prosecutor will review your case and send you a plea offer by mail.

You must then inform the Court whether you accept or reject the offer:

      • If you accept, the Judge will review the matter and, if approved, assess a fine and/or surcharge on the reduced charge.
      • If you reject, you will be mailed a court appearance date.
