PLEAS:

If you have received a traffic ticket and wish to enter your plea by mail, you can do so by filling in the appropriate plea section on your ticket and mail it to the court. If you mail in your plea, you DO NOT need to appear in Court on the date initially indicated on your ticket.

If you have plead NOT GUILTY – you will receive something either from the Town Prosecutor or the court within 4-6 weeks.

If you have plead GUILTY – the Judge will assess your fine(s) / surcharge(s) and you will be sent a fine notice from the court within 2-4 weeks.

PAYMENTS:

If you need to make a payment, you may make payment in person during our regular court office hours. You can mail a money order or bank draft. You can mail, email or fax an authorization to use your credit/debit card. Please provide the card number, expiration date and 3 digit code. Master card or visa only. Please note there is a 2.99% service fee to use a credit/debit card. Please DO NOT mail in cash. We CANNOT accept payment over the phone nor can we accept personal checks.

SMALL CLAIMS:

Forms to file a Small Claims matter are also available at the Court Clerk’s office. Small Claims proceedings may be brought by any individual against anyone who resides or owns a business within the Town of Orchard Park.

The maximum claim allowed is $3,000.00

The filing fee is $10.00, if the claim amount is for $1.00 – $1,000.00 and $15.00 if the claim is $1,001.00 – $3,000.00. The filing fee is payable upon filing the application. The court clerk cannot accept the application without the filing fee.

Town Court is held on the FIRST and SECOND Tuesday of every month with the Town Prosecutor to handle Vehicle and Traffic matters, Town Code and Penal Law violations. The THIRD and FOURTH Tuesday of every month plus the SECOND and FOURTH Thursday of every month with the Assistant District Attorney for Criminal Misdemeanor matters. Court starts at 5:00 pm.
